The auto parts market, along with tobacco, drugs and electronics, shoes and accessories, as well as cigarettes and alcohol, is the most «clogged» illegal products. According to experts, today the sale of such products is increasing by an average of 20% per year, inflicting significant damage to copyright holders. The challenge of counterfeit on the auto parts market was devoted to the online panel discussion «The problem of counterfeit products in the auto parts market».
Illicit circulation of illegal products in the last decade has acquired a massive nature and became an acute problem for copyright holders. Today, actually all auto parts market players have encountered this phenomenon. An existing set of tools opposing the spread of such products allows you to deal with this «epidemic». Specialists involved in the panel discussion, the organizer of which was OSRAM, noted that while this toolkit was not ideal. But even in this form, the impact on the situation with existing means and approaches, as the experience of a number of companies shows, leads to a positive result and a certain progress of counterfeit combat.
Recently, state bodies began to pay attention to the problem of the turnover of illegal products. It is important that the copyright holders themselves develop and implemented their own strategies to combat counterfeit products.
All about counterfeit and its negative manifestations
In the panel discussion, the results of a large-scale study conducted by OSRAM and Tearl Center were made to spread counterfeit products on the Russian auto parts market. The results were disappointing. According to the study, the share of counterfeit auto components in the secondary market of the Russian Federation for 2019 amounted to about 31%, which is comparable to the level of counterfeit in Russia as a whole (30%). According to him, the most «popular» fakes on the spare parts market are «consumables», that is, regularly replaceable details: filters, brake components, belts and chains, pendant parts, and lamps and headlights. For individual categories of components, the share of counterfeit reaches 45%. As a rule, in the risk area there are cars of budget brands or an average price category.
Supporting demand from motorists is due to the cost of such products, which is an average of 30-50% cheaper than originals, as well as the degree of tolerance to counterfeit in society.
The head of the Tear Center noted that the counterfeit problem should be considered from the point of view, above all, the safety of movement. Today there are more than 53 million cars in the country. This is a huge «army of cars», from the technical condition of which depends on the safety of the road. Counterfeit parts are made with serious violations of quality standards, as cheaper materials are used and inappropriate manufacturing equipment is used. As a result, such components, as a rule, fail in order to be much earlier, and can also damage other car systems. It also entails the financial loss of the motorist.
Second aspect. The problem of counterfeit is the problem of socio-economic. It lies in the fact that the illegal imports and the production of counterfeit car components leads to a non-taxation by the state of taxes and customs fees due to their undergoing cost. According to the evaluation, the amount of lost taxes for 2019 only in part of VAT was more than 24 billion rubles. Only the missed incomes of the federal budget of Russia in terms of VAT due to the turnover of counterfeit lamps in 2019 were estimated at 461 million rubles.
Also, this problem concerns motorists who receive auto parts, which fail before the expected period. In addition, this is an economic problem for manufacturers of original autocomponents, which directly affects their competitiveness.

The volume of the counterfeit market in the Russian Federation, according to the «TIAR Center» estimates, amounted to 348 billion rubles. With the total volume of the auto parts market in the amount of 1.1 trillion rubles. At the same time, the growth rate of the counterfeit market is higher than auto parts market growth. This is a disturbing trend.

At the same time, the surveyed research participants note that large-scale e-commerce sites are ready to cooperate and respond to the appeals of copyright holders.
The origin of counterfeit parts has both domestic origin and overseas. Domestic cars are risking to get counterfeit parts, which are produced mainly in Russia. Counterfeit parts for localized models of foreign cars — approximately «50 to 50» — half is produced in the Russian Federation, another half is imported from abroad. Counterfeit for imported models not produced in the Russian Federation has foreign origin.

The uncontrolled supplies of counterfeit spare parts are coming from the territory of neighboring states, and above all member countries of the Customs Union. The essential share of counterfeit is implemented through auto parts stores that absolutely not care about reputation, prefer earnings today instead of the strategic development of their business. Do not contribute to the fight against fakes and low fines in the detection of counterfeit or illegal use of the trademark. Losses of «gray importers» are small. The new trend is to improve the quality of fakes, which can be identified only through professional expertise.
The experience of combating counterfeit products DENSO was very successful. Today, the result of this work is the figure: DENSO counterfeit on the Russian market is less than 1%.
What events were carried out, contributing to such an impressive result? The company has identified all importers of DENSO products that declare goods under this brand at customs. Further, the market was «served» on the presence of control by DENSO. This gave the first positive effect. The capacity of the Russian market has seriously increased and attracts even more manufacturers of components that pay attention to the issues of counterfeit eradication. The REACT operates an investigation unit that performs the titanic work. The organization covers the markets of 105 countries where its members and partners work. Over the past year, the organization has processed about 50,000 cases to identify and withdraw counterfeit, not counting violations on the Internet network. On the Internet 1 million 800 thousand ads were removed. With «Ali Express», about 47 thousand ads were closed with auction sites, including social networks and applications. As a result, about 35 million units of counterfeit products were seized. These numbers characterize work scale.
Global trends that are observed by the organization’s specialists — the contamination of counterfeit on the Internet. And this is a long-term trend to which the controlling authorities should carefully take care of and right holders.
According to Casimierase Sarzhitskas, there is also an arrival of counterfeit on social networks and hidden online shopping. Also growing the number of detentions at customs, but the size of the cargo due to e-commerce decreases. In this regard, the number of administrative and criminal cases is growing.
Market control is carried out on a number of directions. In addition to traditional sales checks, initiating the participation of law enforcement officers, checkpoints, the organization initiated a pilot project in the Czech Republic. The case was opened against the landlord, the market administrator, where counterfeit auto parts were sold. After multiple warnings about the inadmissibility of counterfeit trade, the lawyers of the Organization obliged the administration to include in the lease agreements that sellers and businessmen do not have the right to trade counterfeit. In the end, this case came to the court of the European Union, who confirmed and adopted this case decedent decision that the landlord was responsible for selling in its premises.
And at the end, Casimierase Sarzhitskas spoke about one example of effective cooperation between state bodies and copyright holders. For a long time, the wholesale market was anxious near Warsaw, from which the counterfeach was distributed throughout the region of Eastern Europe. A few years ago, a large-scale market cleaning operation was carried out. It was attended by more than 150 police officers, customs, and representatives of copyright holders were also attended. Law enforcement officers were endowed with special authority: they could open out the outlets, withdraw goods, etc. As a result, more than 100 criminal cases were initiated. But after a while, the sellers of counterfeit products returned to their places in the market.
